DAMINDU SINGITHCLIENT GALLERY TERMS

Simple gallery rules

Made for private viewing, selection and delivery.

These terms apply when a client or invited guest uses a Morrow gallery provided by Damindu Singith, an individual photographer based in Toronto, Ontario. By opening or using a gallery, the user agrees to these terms. Any signed photography agreement with the client takes priority if it says something different. Last updated August 24, 2026.

Private access

A gallery link and any PIN are intended for the client and people the client or photographer chooses to invite. The recipient may share access with intended family members, event participants, or collaborators, but should not post a private link or PIN publicly. Anyone using a shared link must respect these terms.

Proof galleries

Proofs are unfinished work supplied for private review and selection. Unless Damindu Singith gives written permission, proofs may not be published, altered, sold, entered in contests, used commercially, or presented as final photographs. A proof-gallery download option, when enabled, does not change the unfinished status of those files.

Final photographs

After the agreed photography fees are paid, the client receives a personal, non-exclusive licence to download final photographs, make personal copies, share them with friends and family, and post them on personal social-media accounts. This licence does not transfer ownership of the copyright.

Commercial advertising, resale, licensing to another business, publication for compensation, removal of a proof watermark, or use in artificial-intelligence training or datasets requires written permission from Damindu Singith. Vendors, publications and businesses should contact the photographer before using an image.

Copyright and respectful use

Copyright remains with Damindu Singith or another identified rights holder. Clients may crop final photographs as reasonably needed for personal social-media formats, but should not apply filters or edits that materially misrepresent the photographer’s work. Copyright notices, watermarks and embedded ownership information must not be removed.

Selections and notes

The selection tools are provided so clients can communicate choices and reasonable editing notes. A submitted selection can be revised by contacting the photographer or submitting an updated selection while the gallery remains open. A selection does not add work, alter pricing, or change the agreed delivery scope unless the photographer confirms that change.

Downloads and safekeeping

Gallery access and download availability may end on the date shown in the gallery or after reasonable notice. Clients should download their final files promptly and keep at least one backup. The gallery is a delivery service, not a promise of permanent archival storage. The photographer may assist with replacement files when available but does not guarantee indefinite storage.

Acceptable use

Users must not attempt to bypass access controls, guess another gallery address or PIN, scrape or bulk-copy files beyond the provided download tools, introduce harmful code, interfere with the service, or use a gallery in a way that infringes another person’s privacy or legal rights. Access may be suspended when reasonably necessary to protect a client, the photographs, or the service.

Service availability

Reasonable care is taken to keep galleries secure and available, but temporary maintenance, internet problems, provider outages or events outside the photographer’s control may interrupt access. If a gallery does not work as expected, the client should contact the photographer so another reasonable delivery method can be arranged.

Responsibility and consumer rights

To the extent permitted by law, Damindu Singith is not responsible for loss caused by a recipient publicly sharing a private link or PIN, failing to download files before a stated expiry, or using photographs outside the permitted licence. Nothing in these terms limits a right or remedy that cannot legally be excluded under Ontario or Canadian law.

Privacy, law and contact

The Client Gallery Privacy Policy explains how gallery information is handled. These terms are governed by the laws of Ontario and the applicable laws of Canada. Questions, permission requests and disputes should first be sent to Damindu Singith through the studio website so there is an opportunity to resolve them directly.
